Privacy Policy

The following Privacy Policy describes how we collect, use, process, and disclose your information, including personal information, in conjunction with your access to and the use of the Berthlii Platform.

When this policy mentions “Berthlii,” “we,” “us,” or “our,” it refers to the Berthlii company that is responsible for your information under this Privacy Policy (from herein the “Data Handler”). This Private Policy also applies when using the Payment Services Stripe, for more information on how Stripe handles your shared data please visit: you will also be providing your information, including personal information, such as ID, passport, licenses, DOB, etc, to us or our payments platforms.

I. WHAT INFORMATION WE COLLECT

There are three categories of information we collect.

  1. Information You Give to Us.
  2. Information that is necessary for the correct and continued use of Berthlii.

    We will ask for and collect the following personal information about you when you use any of Berthlii’s services. This information is necessary hence without it we cannot fully fulfil our part of the contract between you and us and also to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.

    Account Information. When you sign up for an Berthlii Account, we require certain information such as your first name, last name, email address.

    User Profile.To make certain features available to you, we may ask you to provide, once registered, additional information, such as home address, phone number, Passport number, yacht license, yacht information, and a profile picture.

    Marina Profile and Listing Information. To use certain features as a marina, such as your bookings or creating a Marina Listing, we may ask you to provide information, which may include your fiscal and/or address, phone number, VAT number, and profile picture.

    ID Verification Information. To help create and sustain a trusting environment, we may collect identity verification data, such as images of your passport, national ID card, yachting license, VHF license, VAT certificate, or other authentication information.

    Communicating with Berthlii and the Community. When you communicate with Berthlii or use our Platform to communicate with other Users, we collect information about your communication and any information you choose to provide.

    Information you choose to give us.

    You may choose to provide us with additional personal information in order to obtain a better user experience when using Berthlii. This additional information will be processed based on your consent.

    Profile Information. You may choose to provide additional information as part of your Berthlii user profile, this information such as gender, city of origin, and a personal description, “Bio”, may become part of your public profile page, and will be visible to others in the community.

    Additional Information. You may also choose to provide us with other information when you fill in a form, conduct a search, update or add information to your Berthii Account, or profile, respond to questionnaires, participate in promotions, or use other Berthlii provided features.

  3. Information We Automatically Collect from Your Use of Berthlii.
  4. When you use Berthlii, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the adequate quality of service of the contract between you and us, to enable us to fulfil with legal obligations required.

    Geo-location Data. When you use certain features of the Berthlii Platform, such as weather or others, we may collect information about your precise or approximate location determined by data such as your IP address or mobile device’s Location services, such as GPS, to provide you better user experience. Most mobile devices will allow you to control or disable the use of location services for applications in the device’s settings menu, under the privacy section. We may also collect this information when you are not using the app if this service is enabled through your settings or device privacy permissions.

    Usage Information. We collect information about your usage of the Berthlii Platform such as the pages, content, profiles, blog posts you view, your searches for Marina Listings, Experiences, bookings you have made, and other actions you may have performed during your visit to the Berthlii Platform.

    Log and Device Data. We automatically collect log data and device information when you access and use Berthlii, even if you have not yet a created your Berthlii Account or logged in. That information may included: details about how you’ve navigate on the Berthlii Platform, IP address, access dates and times log, hardware and software information, device information, unique identifiers, crash data, and cookies data, among other things.

    Cookies. We use cookies, such as web beacons, and mobile identifiers. We may also allow our business partners (such as marinas and weather forecast platforms) to use these tracking technologies on Berthlii. Currently you may disable the usage of cookies through your browser settings without any reduction in the performance of the User experience.     Payment Transaction Information. Berthlii payment transactions are collected by Stripe and therefore are governed by Stripe’s own policies. You can learn more about them here: https://stripe.com/es/privacy

  5. Information from Third Parties Collected by Berthlii.
  6. We may collect information, including personal information, that third parties provide about you when they use our Platform or obtain information from other sources and combine that with information we collect. We do not guarantee, handle, supervise, control or respond for how the third parties involved are providing your information or process your personal data, and any request for additional information regarding the disclosure of your personal information is handled should be directed to such third parties.

    Third Party Services. If you link, connect, or login to your Airbnb Account with a third party service (e.g. Facebook), the third party may send us personal data such as your registration and profile information from that service. This information is controlled solely by that service or as authorized by you to do so. If you wish to modify such permissions you may do so via your privacy settings at that service.

    Additional Sources. To the extent permitted by law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive information about you and your activities on and off Berthlii.com through partnerships, or about your experiences and interactions.

II. HOW WE USE THE INFORMATION WE COLLECT

We use, store, and handle information, including personal information, about you to provide, improve, and develop the Berthlii Platform, as well as to create and maintain a trusting, safe, and empowering environment and comply with our legal duties. We also collect this data to further the User experience.

  1. To Provide, Improve, and Develop.
    • Enable you to access and use the Berthlii Platform.
    • Empower you during your trips with helpful tools
    • Enable you to communicate with the Community.
    • Enable you to get local and international weather forecasts.
    • Operate, protect, improve, and optimize our Platform and experience, by performing analytics, conducting research, building better features.
    • Provide customer service.
    • Send you support messages, updates, security alerts, and account notifications, newsletters, weather alerts and forecasts.
    • To operate, protect, improve, and optimize the Berthlii Experience, and personalize and customize your experience (such as making Marina Bookings suggestions), conduct personalized case studies based on your interactions with the Berthlii Platform, your search and booking history, profile information and preferences, and other content you submit to our Platform.
  2. Create and Maintain a Safe and Trusting Community.
  3. At Berthlii we strive to create a safe and trusting environment for our Users and business partners, hence some of the actions employed to further our mission are:

    • Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity.
    • Verify or authenticate information or identifications provided by you
    • Comply with our legal duties.
    • Resolve any disputes, or claims, with any of our Users, business partners, and enforce our agreements with third parties.
    • Enforce our Terms of Services and other policies.
  4. Provide, Tailor, Measure, and Improve our Advertising and Marketing to Your Needs.
  5. Send you promotions, marketing, advertising, and other information that may be of interest to you based on your preferences (including information about Berthlii, partner campaigns and services) and social media advertising through social media platforms such as Facebook or Instagram).

    Personalize, measure, and improve our advertising.

    Tailor our promotional messages, marketing, advertising and other information that we think may be of interest to you based on the information you provide to us, your interactions with our Platform, information obtained from third parties, or business partners, and your search and booking history.

    You can opt-out of receiving marketing communications from us by following the unsubscribe instructions included in our marketing communications or changing your notification settings within your Berthlii Account Privacy Settings.

    III. SHARING & DISCLOSURE

    1. With Your Consent
    2. We share your information, including personal information, sole on the subjects which you have consented to, such as when you authorize a third party application or website to access your Berthlii Account or when you participate in any promotional activity by Berthlii, our Business Partners or third parties.

    3. Sharing between Users.
    4. To facilitate bookings and other interactions between our Community, we may need to share certain information, including personal information, with other Users, as it is necessary to sustain the adequate performance of our Platform and fulfil our part of the contract between you and us:

      When you as a User submit a booking request, certain information about you is shared with the Marina, (and business partners, if applicable, see Berthlii Experiences), including your first name, last name, the full name of any additional crew members, your passport, yacht information, and other information you agree to share. When your booking is confirmed, we will disclose additional information to assist with confirming the booking, like your phone number, yacht information, passport, and port of origin.

      When you as a Marina (or business partner, if applicable) have a confirmed booking, certain information is shared with the User to coordinate the booking, such as your business name, Latitude and Longitude, phone number, email, services offered on site, or ratings.

      Your billing and payout information will never be shared with other Users.

    5. Profiles, Listings, and other Public Information.
    6. The Berthlii Platform lets you publish information, including personal information, that is visible to the general public. For example:

      • Parts of your public profile page, such as your first name, last name, your description(“Bio”), profile image, and posts, are publicly visible to others.
      • Marina pages are publicly visible and include information such as the services, POIs, and Experience’s approximate location (marina and city) or precise location, or any additional information you choose to share.
      • After completing a booking, Users, Marinas and business partners may write Reviews and rate each other. Reviews and Ratings are a part of your public profile page and may also be shown elsewhere on the Berthlii Platform (such as the Listing page, or Marina and Experiences dedicated pages).
      • When you submit content in a community or discussion forum, blog or social media post, or use a similar feature on the Berthlii Platform, that content will be publicly visible.
      • Additionally, information you share publicly on the Berthlii Platform may be indexed by third party search engines (such as Google, Bing, or others). In some cases, you may opt-out of this feature in your Account settings. If you change your settings or your publicly visible content, these search engines may not update their databases. We do not control, or guarantee the quality, of the practices used by third party search engines, and they may use caches containing your outdated information even after you’ve update your Account settings.
    7. Additional Services by Marinas and Business Partners.
    8. Marinas, and business parters, may need to use third party services available through the Berthlii Platform to assist with managing their Bookings or providing additional services requested by you, the User, such as provision, technical or transport services providers. Marinas may use features on the Berthlii Platform to share information about the User (like check-in and check-out dates, User’s first name, last, passport number, crew members list, yacht information, email and phone number) with such third party service providers for the purposes of organizing the stay, managing the bookings, or providing other services requested, or needed to better improve the User’s experience.

    9. Compliance with Law, Legal Requests, Preventing Harm and Protection of our Rights.

Berthlii and Berthlii business partners, as well as Marinas may disclose your information, including personal information, to courts, customs, local law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required or permitted to do so under applicable law or if such disclosure is reasonably necessary: (i) to comply with our legal duties, (ii) to comply with legal process and to respond to claims asserted against Berthlii, (iii) to respond to verified requests associated to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our Users to legal liability, (iv) to enforce and administer our Terms of Service, or other agreements with Users, or (v) to protect the rights, property or personal safety of Berthlii, its employees, its Users, or the general public.

    11. Social Media Platforms.
    12. Where permissible according to applicable law we may use certain limited personal information about you, such as your email address, to hash it and to share it with social media platforms, such as Facebook, Instagram or Google, to generate leads, drive traffic to our websites or otherwise promote our products and services or the Berthlii Platform. These processing activities are based on our legitimate interest of undertaking marketing activities that offer you products or services that may add value to your experience as our User and be if your interest.

      The social media platforms with which we may share your personal data are not controlled, handled, or supervised by Berthlii, and therefore cannot exercise any form of guarantee of how your data will be regulated or handled. Therefore, any questions regarding how any of the social media platform service providers handles your personal data must be directed to such provider.

      Please note that you may, at any time ask Berthlii to cease processing your data for these direct marketing purposes by sending an e-mail to Unsubscribe.

    13. Aggregated Data.
    14. We may also share aggregated information (information about our users and business partners, that we combine together so that it no longer identifies or references an individual user or business partner) and other anonymized information for general compliance with the recent regulations, industry, market analysis, demographic profiling, case studies, marketing and advertising, and other business purposes.

    IV. OTHER IMPORTANT INFORMATION

    1. Analysing your Communications.
    2. We may review, scan, or analyse your communications on our Platform for regulatory compliance, case studies, investigation, product development, research, and customer support purposes. We may also scan, review, or analyse messages to debug, improve, and expand product quality and offerings. We generally use automated methods where reasonably possible. However, occasionally we may need to manually review some communications, such as for product development and customer support, or to assess and improve the functionality of these tools. We will not sell reviews or analyses of these communications to any third party.

    V. BUSINESS PARTNERS

    The Berthlii Platform may contain links to third party websites or services, such as third party integrations, co-branded services, or third party-branded services (“Business Partners”). We don’t own or control these Business Partners and when you interact with them, you may be providing information directly to the Business Partner, Berthlii, or both. Our Business Partners will have their own policies about the collection, handling, and disclosure of your information. We encourage you to review the privacy policies of the other websites you visit and exercise your rights if need be regarding your data protection.

    VI. KNOW YOUR RIGHTS

    You may exercise any of the rights described in this section before your Berthlii (“Data Handler”) by sending an email to My Rights. Please note that we may ask you to verify your identity before taking any action on your request.

    1. Managing and Handling Your Information.
    2. You may access and update some of your information through your Account settings. If you have chosen to connect your Berthlii Account with a third-party application, like Facebook, Google, or Twitter, you can change your settings and remove permission for the app by changing your App settings from within your Facebook Account or directly under your Berthlii Account settings, only for the information provided directly to Berthlii by you. You, the User is solely responsible for keeping, and maintaining, your personal information up-to-date.

    3. Correction of Inaccurate, False or Incomplete Information.
    4. You have the right to ask Berthlii to correct inaccurate or incomplete personal information, which you cannot update yourself within your Berthlii Account.

    5. Data Access and Portability.
    6. By law, you may be entitled to request copies of your personal information held by us. You may also exercise your right to request copies of personal information that you have provided to Berthlii in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible). You can do so by sending us an email to Data Access.

    7. Data Retention and Deletion.
    8. Generally, we retain your personal information for as long as it is necessary so as to fulfil our duty as service provider, upkeeping the required performance and to comply with our legal duties. If you no longer want us to use your information to provide, and continue to enable, the Berthlii Platform or other services to you, you can request that we delete your personal information and close your Berthlii Account. Please note that if you request the complete removal of your personal information:

      • We may retain some of your personal information as necessary for us to fulfil our business interests, such fraud, identity theft prevention, improving the community’s safety.
      • We may retain and use your personal information to comply with our legal obligations, such as tax, legal reporting, auditing obligations, general account.
      • Information you have shared with others (e.g., Reviews, posts), as well as some copies of your information (e.g., log records) may remain in our database and continue to appear publicly, in the case of the former, on our Platform, even after your Berthlii Account has been cancelled. However, association of such information to you will be removed.
      • Because we protect the Berthlii Platform from accidental, intended or malicious loss and destruction, small traces of your personal information may not be completely removed from our backup systems for a limited time period.
    9. Withdrawing Consent and Restriction of Processing.
    10. You may withdraw your consent at any time by changing by communicating to Berthlii specifying which consent you wish to withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.

    11. Handling Complaints.
    12. You can exercise your right to lodge complaints about how Berthlii handles data processing before any competent data protection authority in your local community or otherwise.

    VII. SECURITY

    We are continuously implementing and updating security measures to help protect your information against unauthorized access, loss, destruction, or alteration. Some of the safeguards we use to protect your information are firewalls and data encryption, backups and information access controls. If you know or have reason to believe that your Berthlii Account credentials have been lost, stolen, modified, or compromised or in case of any actual or suspected unauthorized use of your Berthlii Account, please contact us immediately following the instructions in the Contact Ussection below.

    VIII. CHANGES TO THIS PRIVACY POLICY

    We reserve the right to modify this Privacy Policy at any time in accordance with this provision. If we make changes to this Privacy Policy, we will post the revised Privacy Policy on our Platform and update the “Most Recent Update” date at the top of this Privacy Policy. We will also provide you with notice of the modification by email at least thirty (15) days before the date they become effective. Should you disagree with the revised Privacy Policy, you may cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the Berthlii Platform will constitute a consent with the revised Privacy Policy.
